1. Introduction
Welcome to OnDemandPsychiatry, a digital platform owned and operated by MTP Psychiatry LLC, a U.S.-based psychiatric and psychopharmacology company. These Terms and Conditions (“Terms”) govern your access and use of the OnDemandPsychiatry App (“App”), including all content, features, and membership services made available through it.
By accessing or using the App, you agree to comply with and be legally bound by these Terms. If you do not agree, please discontinue use immediately.
OnDemandPsychiatry is a professional platform created by Dr. Tanveer Padder, a triple-board certified psychiatrist, psychopharmacologist, and addiction specialist. The App provides healthcare professionals with advanced tools for clinical decision support, medication management, Co-Pilot assisted documentation, diagnostic verification, and education to enhance psychiatric practice and improve patient outcomes.
These Terms apply to all users of the App, including psychiatrists, nurse practitioners, physicians, residents, physician assistants, therapists, and other licensed healthcare professionals. All users must comply with these Terms and with all applicable U.S. laws, including HIPAA and medical ethics standards.
2. Use of the App
2.1 Access and Eligibility
The App is intended for licensed healthcare professionals and individuals aged 18 and above who are legally able to form contracts under applicable law.
By registering and using this App, you represent and warrant that:
- You are a healthcare professional with valid credentials or are using the App for educational purposes under supervision.
- All information you provide is accurate and truthful.
- You will use the App in compliance with all applicable laws, regulations, and professional standards.
2.2 Permitted Use
You may use OnDemandPsychiatry for:
- Clinical Support: Access evidence-based guidance for psychiatric diagnosis, treatment, dosing, and documentation.
- Professional Use: Utilize the App’s Co-Pilot assisted tools to enhance workflow efficiency and accuracy in psychiatric care.
- Educational Growth: Improve your knowledge in psychopharmacology and psychiatry through interactive, clinically validated tools.
You are granted a limited, revocable, non-exclusive license to use the App solely for lawful, professional, and educational purposes.
2.3 Prohibited Use
You agree not to:
- Use the App for illegal, unethical, or non-clinical commercial purposes.
- Enter false data or use the App to provide direct patient care without appropriate professional oversight.
- Attempt to hack, reverse-engineer, or disrupt the App’s operations.
- Share your account with unauthorized users.
- Violate HIPAA, privacy, or patient confidentiality laws.
Violation of these terms may result in suspension or termination of your account and possible legal action.
3. Account Registration and Security
3.1 Account Creation
To access premium features, memberships, and documentation tools, you must create an account. You must provide accurate and complete information including your name, email, credentials, and payment details.
You are responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorized access, notify support@mtppsychiatry.com immediately.
3.2 Account Termination
OnDemandPsychiatry reserves the right to suspend or terminate accounts that violate these Terms, misuse the platform, or engage in illegal or unethical activities.
Upon termination, you must cease all use of the App and delete any proprietary data obtained through it.
4. Services Provided
4.1 Membership Access
The App operates on a membership-based model. Healthcare professionals can subscribe for access to AI tools, documentation automation, and clinical decision support systems designed for psychiatric practice.
Membership levels may include varying degrees of access, such as:
- Basic Access – Limited AI tools and educational materials.
- Professional Membership – Full access to decision support, diagnostic verification, and documentation automation.
4.2 Clinical Decision Support
The App provides algorithm-based recommendations, medication guides, and titration plans. These tools are for informational and educational purposes only and do not replace independent clinical judgment. Users remain fully responsible for their professional decisions and patient care.
4.3 Documentation and Notes Generation
The App may generate SOAP notes, psychiatric evaluations, and billing codes using AI technology. These generated materials must be reviewed and approved by the user before use in a clinical setting.
4.4 Patient Safety and Compliance
The App supports professional users in maintaining safety standards and compliance with HIPAA. However, users are solely responsible for ensuring that patient information is entered, stored, and shared in compliance with federal and state privacy laws.
5. Payments, Subscriptions, and Refunds
5.1 Payment Terms
Membership plans and service fees are displayed clearly within the App. All payments must be made through approved, secure payment processors. By purchasing a membership, you authorize MTP Psychiatry LLC to charge your selected payment method.
5.2 Subscription Renewals
Some memberships may auto-renew monthly or annually unless cancelled. You can manage or cancel subscriptions through your account settings before the next billing cycle.
5.3 Refund Policy
Refunds are handled in accordance with our Refund Policy. Typically, no refunds are issued once digital access or services have been utilized. Exceptions may apply in cases of duplicate billing or technical issues.
6. Privacy and Data Security
6.1 Data Collection
We collect user data (name, email, credentials, and usage analytics) to provide services, enhance functionality, and ensure security. Personal information is never shared or sold to third parties without your consent.
6.2 HIPAA Compliance
Although OnDemandPsychiatry does not store or transmit identifiable patient data, all operations are designed to comply with HIPAA standards. Users must ensure that any patient-related data entered complies with all applicable U.S. privacy regulations.
6.3 Data Protection
We use encryption, firewalls, and secure data hosting to safeguard user information. However, no system is 100% secure, and we cannot guarantee absolute protection against breaches.
7. Intellectual Property
All intellectual property, including algorithms, clinical databases, content, graphics, and app functionalities, are the sole property of MTP Psychiatry LLC and are protected under U.S. copyright and trademark law.
Users may not copy, distribute, or modify any part of the App without express written permission.
8. Limitation of Liability
OnDemandPsychiatry is intended as a clinical support and educational tool, not a substitute for medical diagnosis or treatment. The app does not provide medical advice, and all final decisions remain the responsibility of the licensed healthcare professional.
Under no circumstances shall MTP Psychiatry LLC, its affiliates, or its officers be liable for any direct, indirect, or consequential damages resulting from use or inability to use the App.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, USA, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Maryland, United States.
10. Amendments
We reserve the right to modify or update these Terms at any time. Continued use of the App following changes constitutes acceptance of the revised Terms.
